General Terms and Conditions

These General Terms and Conditions (hereinafter referred to as the โ€œGeneral Terms and Conditionsโ€) apply to the offer and delivery of the products offered for sale on our webshop www.rubiomonocoat.no (hereinafter referred to as the โ€œProductsโ€). Please read these General Terms and Conditions carefully before ordering any of our Products online. You will be bound by these Terms and Conditions if you complete the online ordering process.

1. Identity of the Seller โ€“ Customer Description

1.1. The Products are sold to you by:

Rubio Monocoat Norway AS, a private company governed by Norwegian law, established at: Kolonivegen 43, 2072 DAL, registered in the Brรธnnรธysund Register, organization number NO920826148MVA (hereinafter referred to as the โ€œSellerโ€).

1.2. Any natural person placing an order outside their business activity via the Sellerโ€™s webshop is referred to in these General Terms and Conditions as the โ€œCustomerโ€.

2. Scope of Application

These General Terms and Conditions apply to any offer made by the Seller, all orders placed by the Customer, and any agreements between the Seller and the Customer related to the purchase of Products via our webshop (hereinafter referred to as the โ€œSales Contract(s)โ€). Unless otherwise expressly agreed in writing, the validity of any other terms and conditions is expressly excluded.

3. Ordering Process and Conclusion of the Sales Contract

3.1. The Sales Contract is concluded as soon as the Seller has accepted the Customerโ€™s order via the webshop by sending an order confirmation by email containing information about the ordered product(s) and a copy of these General Terms and Conditions.

3.2. The Seller reserves the right to reject an order if the Product will not be available for a long period. The Customer will be informed and any amount already paid will be refunded.

4. Prices

4.1. The prices of the Products are those stated in the webshop at the time of ordering. Muylle-Facon is not bound by any material error, meaning a technical or input error, in the prices displayed in the webshop. In the event of such an error, Muylle-Facon will inform the Customer that the ordered Product was incorrectly priced in the webshop, after which the Customer has 14 calendar days from the date of notification to withdraw from the agreement.

4.2. All prices include VAT at the applicable rate in the Customerโ€™s country of residence. All prices exclude delivery costs. Before placing the order, the total price including any fees or costs will be clearly presented to the Customer.

5. Payment Methods

The Customer must pay for the Products in advance at the time the order is placed. Payment can be made using the following methods:

  • Credit/Debit Cards: Visa, Mastercard, Maestro, American Express
  • Digital Wallets: Shop Pay, Apple Pay, Google Pay, PayPal

The Customer guarantees that they have the legal right to make online payments using one of these payment methods and that the bank/PayPal account has sufficient funds to pay the total price.

6. Delivery

  • Products will only be shipped to addresses in Norway.
  • The Seller undertakes to deliver the Products to the Customer within a period of 5 calendar days after receipt of payment, unless another delivery date has been expressly agreed at the time of concluding the Sales Contract. If the Seller is unable to deliver the Products within the delivery period, the Customer will be informed in writing and a new reasonable delivery date will be announced. If this new delivery period is also exceeded, the Customer has the right to cancel the order.
  • he Seller reserves the right to make partial deliveries of the ordered Products in case of temporary unavailability or delay in delivery. The Customer will be informed if partial delivery is made.
  • If delivery is delayed because the Customer unreasonably refuses to accept the Products or has not collected them within a reasonable time, the Seller has the right to cancel the Sales Contract and no longer make the Products available for delivery or collection.
  • The order will be delivered to the Customer at the address specified during the order process. Upon delivery/collection, the Customer must check the packaging for any damage. The Customer is also obliged to examine the Products upon delivery for visible defects/damage and quality deficiencies.
  • Any complaints regarding visible defects, damage and/or incomplete deliveries must be notified in writing by the Customer, including a clear photo of the damaged packaging/visible defects, no later than two (2) days after delivery/collection of the Product(s). Complaints regarding defects or visible deficiencies not reported within the above-mentioned period will not be processed by the Seller.
  • Any risk of damage or loss of the Products is transferred to the Customer at the time the Products are delivered/collected.

7. Cancellation

The Customer has the right to cancel the order without giving any reason and without cost before the Products have been shipped by Rubio Monocoat. Upon cancellation, the Customer will receive confirmation and any amount already paid will be refunded.

Please note that once a shipping confirmation has been received, it is no longer possible to cancel the order. However, the Customer may choose to return the Product(s) after delivery in accordance with the withdrawal procedure described below.

8. Right of Withdrawal

You have the right to withdraw from your purchase within 30 days of receiving your order. You do not need to give a reason.

To exercise your right of withdrawal, you must register your return online via your personal account. Please note that we don't accept return requests via email.

How to request a return:

  1. Log in to your account on our website.
  2. Navigate to "Orders" in your account menu.
  3. Select the order containing the items you wish to return.
  4. Click on "Request Return" and follow the prompts to complete your request.

Once your request is submitted, you will receive further instructions on how to ship the products back to us.

9. Warranty

9.1. The Customer is entitled by law to a 2-year warranty. The statutory warranty covers any defect or deficiency in a Product that appears within a period of 2 years from the delivery date. The Customer must inform the Seller of the defective Products within a reasonable time after the Customer became aware of the defect or should reasonably have become aware of the defect. To claim the warranty, the Customer must also provide the Seller with proof of purchase.

9.2. If a defect occurs within the statutory warranty period of 2 years, the Customer must follow the same procedure as described above under โ€œRight of Withdrawalโ€. Once the Customer has returned the defective Product to the Seller and the Seller has received it, a new Product will be sent and delivered to the Customer if it is still in stock/available (from the Sellerโ€™s supplier(s)) and the Seller covers any costs related to the replacement, or the Product delivered to the Customer will be repaired. If replacement or repair is not possible within a reasonable time, the Customer has the right to cancel the Sellerโ€™s Sales Contract and the amount already paid by the Customer will be refunded in accordance with the refund terms above.

The warranty does not apply if the delivered Products have been exposed to abnormal conditions or have otherwise been used or handled incorrectly or abnormally in violation of the instructions for use or instructions on the packaging.

10. Contact Information โ€“ Complaint Procedure

10.1. If the Customer has questions, requests more information, or wishes to complain about the purchase, the Customer may contact customer service at +47 63 95 63 95. Customer service may also be contacted in writing at Rubio Monocoat Norway AS, Kolonivegen 43, 2072 Dal. The Seller will do its best to respond to the Customerโ€™s request within 2 business days.

10.2. If the Customer is not satisfied with the handling of the complaint, the Customer may contact the Norwegian Consumer Council. It is also possible to submit a complaint via the EU Online Dispute Resolution platform: http://ec.europa.eu/odr.

11. Use of Personal Data

The Seller processes the Customerโ€™s personal data only in accordance with the privacy policy available on the website.

12. Liability

12.1. The webshopโ€™s Products are described and displayed as accurately as possible. The Seller cannot be held liable for any errors that occur when images and accompanying text are placed for presentation and description of the Products on the site.

12.2. The Seller cannot be held liable for loss, costs, or damages that may arise as a result of delayed Product delivery due to depleted Product stock. Without prejudice to the rights and remedies available to the Customer under applicable legislation and/or these General Terms and Conditions, the Sellerโ€™s liability for direct damages is limited to the value of the Products ordered, except in cases of fraud or intentional misconduct. The Seller is never liable to the Customer for any indirect damages.

13. Transfer

The Seller has the right to transfer the Sellerโ€™s rights and obligations under the Sellerโ€™s Sales Contract(s) to a Supplier (e.g., in connection with delivery of the Product(s)), but this does not affect the rights and obligations under these Terms and Conditions.

14. Force Majeure

The Seller is not responsible for failure or delay in performance if this is caused by force majeure. In the event of force majeure, the Customer will be informed by the Seller, and both parties will have the option to cancel the sale, without this entitling the Customer to compensation.

15. Severability

If one or more of these Terms and Conditions are declared wholly or partially invalid or unenforceable, such invalidity will not affect the remaining provisions, which remain binding and enforceable.

16. Amendments

The Seller may amend these General Terms and Conditions at any time. The version applicable at the time of ordering shall apply to the Sellerโ€™s Sales Contract.

17. Governing Law

These General Terms and Conditions are governed by Norwegian law. This means that any disputes arising regarding the Sales Contract will be resolved in accordance with Norwegian law.
